BETA PROGRAM TERMS

1. BETA PROGRAM OVERVIEW
SkyTech Services, LLC ("SkyTech," "we," "us," or "our") is pleased to offer you the opportunity to participate in our Beta Program for our drone map processing Software-as-a-Service (SaaS) platform (the "Beta Service"). These Beta Program Terms ("Beta Terms") supplement and are incorporated into our standard Terms of Use and Privacy Policy.
2. BETA PROGRAM ELIGIBILITY
Participation in the Beta Program is by invitation or application only. SkyTech reserves the right to accept or reject any application for Beta Program participation at our sole discretion.
3. BETA PROGRAM PRICING
3.1 Beta Subscription Fee
Beta Program participants will pay a monthly subscription fee of $19.99 for access to the Beta Service.
3.2 Payment Terms

Beta subscription fees are billed monthly in advance

Your subscription will automatically renew each month until you cancel or the Beta Program concludes

Payment is due upon subscription activation and on the same calendar day each subsequent month

All payments are processed through our secure third-party payment processor

Fees are non-refundable except as expressly provided in these Beta Terms
3.3 Taxes
All fees are exclusive of applicable taxes. Customer is responsible for all applicable federal, state, and local taxes, duties, and assessments (except taxes based on SkyTech's net income). If SkyTech is required to collect sales tax, such tax will be added to the invoice and charged separately.
3.4 Future Production Launch Benefit
As a Beta Program participant, you will be eligible for a 30% discount on our standard production pricing for a period of three (3) years following the official production launch of our Service, provided you maintain continuous paid participation throughout the entire Beta Program period without interruption.
4. BETA SERVICE CHARACTERISTICS
4.1 Pre-Release Software
You acknowledge and understand that the Beta Service is pre-release software that may contain bugs, errors, and other issues. The Beta Service is provided for testing and feedback purposes only.
4.2 No Service Level Guarantees
IMPORTANT: There are no service level agreements, uptime guarantees, or performance warranties for the Beta Service. While we strive to maintain high availability (targeting 99.9%+ uptime), you will not receive refunds, credits, or other compensation for any service interruptions, outages, or performance issues during the Beta Program.
4.3 Feature Limitations
The Beta Service may have limited features compared to the planned production version. Features may be added, modified, or removed during the Beta Program without prior notice.
4.4 Data Backup Responsibility
You are solely responsible for maintaining backups of your data. While we implement reasonable data protection measures, we strongly recommend you regularly export and backup your mapping deliverables and important data.
5. PARTICIPANT OBLIGATIONS
5.1 Feedback Requirements
As a Beta Program participant, you agree to:

Provide periodic feedback through surveys and questionnaires as requested by SkyTech

Report bugs, errors, and technical issues promptly through our designated support channels

Participate in at least one (1) live feedback session via video conference (Zoom or similar platform) during your Beta Program participation

Respond to reasonable requests for feedback on product features, pricing structure, and future development plans
5.2 Feedback Frequency
We may request feedback through various methods including:

Monthly or quarterly surveys

Email questionnaires
-
In-app feedback prompts
-
Scheduled video conference sessions
5.3 Confidentiality
You agree to maintain the confidentiality of any non-public information about the Beta Service, including but not limited to:

Unreleased features and functionality

Performance metrics and capabilities
-
Pricing information for the production launch
-
Technical specifications and limitations
6. INTELLECTUAL PROPERTY
6.1 Beta Feedback License
By providing feedback, suggestions, or ideas about the Beta Service, you grant SkyTech a perpetual, irrevocable, worldwide, royalty-free license to use, modify, and incorporate such feedback into our Service without any obligation to compensate you.
6.2 User Content Rights
Your rights to uploaded imagery and mapping deliverables remain as specified in our standard Terms of Use and Privacy Policy. SkyTech retains the same limited commercial license to use your content as described in those documents.
7. BETA PROGRAM TERMINATION
7.1 Termination by SkyTech
SkyTech may terminate your participation in the Beta Program at any time, with or without cause, by providing thirty (30) days written notice. Upon termination, you will receive a prorated refund for any unused portion of your current monthly subscription.
7.2 Termination by Participant
You may terminate your Beta Program participation at any time by canceling your subscription through your account settings. Termination will be effective at the end of your current billing cycle, and no refund will be provided for the current billing period.
7.3 Transition to Production
When the production version of our Service launches, Beta Program participants will be automatically transitioned to an appropriate production subscription plan. You will receive at least sixty (60) days advance notice of the transition, including details about:

Production pricing and plan options

Your 30% discount eligibility and application process

Any changes to terms of service
-
Data migration procedures
7.4 Automatic Renewal and Discount Forfeiture
Your Beta Program subscription will automatically renew monthly until you explicitly cancel or your participation is terminated. To maintain eligibility for the 30% production discount, you must remain an active, paying participant through the entire Beta Program period.
Discount eligibility will be forfeited in the following circumstances:

Voluntary Cancellation: If you voluntarily cancel your Beta Program subscription before the official conclusion of the Beta Program, you will immediately forfeit your eligibility for the 30% production discount.

Payment Failure: If your payment method fails and you do not update your payment information within fifteen (15) days of notification, your subscription will be automatically terminated and you will forfeit your eligibility for the 30% production discount.

Termination by SkyTech: If SkyTech terminates your Beta Program participation for any valid reason, including but not limited to:

Violation of these Beta Terms

Violation of our Terms of Use or Privacy Policy

Failure to provide required feedback or participate in feedback sessions

Misuse of the Beta Service
-
Any conduct that SkyTech determines, in its sole discretion, is detrimental to the Beta Program or other participants
You will immediately forfeit your eligibility for the 30% production discount.
Important Notes:

Once forfeited, discount eligibility cannot be restored under any circumstances
-
SkyTech will provide reasonable notice of payment failures and an opportunity to cure payment issues before termination
-
Participants are responsible for maintaining current payment information and monitoring their account status
-
The Beta Program conclusion date will be communicated to all participants with at least sixty (60) days advance notice
8. DISCLAIMERS AND LIMITATIONS
8.1 Beta Service Disclaimer
THE BETA SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT ANY WARRANTIES OF ANY KIND. SKYTECH EXPRESSLY DISCLAIMS ALL WARRANTIES, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
8.2 Limitation of Liability
IN NO EVENT SHALL SKYTECH BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR RELATING TO YOUR PARTICIPATION IN THE BETA PROGRAM OR USE OF THE BETA SERVICE, INCLUDING BUT NOT LIMITED TO LOSS OF DATA, BUSINESS INTERRUPTION, OR LOST PROFITS.
8.3 Data Loss Risk
You acknowledge that the Beta Service may result in data loss, corruption, or other issues. SkyTech shall not be liable for any loss of data or content during the Beta Program.
9. SUPPORT AND COMMUNICATION
9.1 Beta Support
Beta Program participants will receive support through designated beta support channels. Response times may vary, and support may be limited compared to production service levels.
9.2 Communication Preferences
By participating in the Beta Program, you consent to receive communications from SkyTech regarding:

Beta Program updates and announcements

Feedback requests and surveys
-
Technical support and troubleshooting
-
Production launch notifications
-
Payment failure notifications and account status updates
10. COMPLIANCE WITH STANDARD TERMS
These Beta Terms supplement our standard Terms of Use and Privacy Policy. In the event of any conflict between these Beta Terms and our standard terms, these Beta Terms shall control with respect to Beta Program participation.
11. MODIFICATIONS TO BETA TERMS
SkyTech may modify these Beta Terms at any time by providing notice through email or in-app notifications. Continued participation in the Beta Program after such notice constitutes acceptance of the modified terms.
12. GOVERNING LAW
These Beta Terms shall be governed by and construed in accordance with the laws of the State of [INSERT STATE], without regard to its conflict of law provisions.
